ORDER
DECEMBER 15, 2025
Now pending before the Court is the Defendant’s motion to stay the prosecution and
disqualify Alina Habba from prosecuting this case as the Acting United States Attorney for
the District of New Jersey. As it appears that Ms. Habba no longer purports to exercise the
functions and duties of the office of the United States Attorney for the District of New
Jersey in any capacity,1 no relief remains to be granted on the pending motion.
Accordingly, IT IS HEREBY ORDERED that:
1. The motion to disqualify and stay (Doc. 107) is DENIED AS MOOT;
2. The Clerk is directed to transfer this matter back to the originally presiding
judge.
