          Defendant requests that the Court understand the following
17
     as background on this matter.
18
          Death of her husband May 2022. Katherine’s husband was
19
     gunned down and killed in approximately May of 2022, killed by
20
     a   very   violent     gang     member     who    felt    her    husband   had
21
     disrespected him in public previously. The gunman belongs to
22
     the “Nazi Lowrider” gang. The shooting occurred right in front
23
     of their house. A few days later, their house was shot up as a
24
     warning to not cooperate with law enforcement.                  Despite this,
25
     the family did cooperate with law enforcement.                  The gunman was
26
     detained, but eventually released.               Soon thereafter, he was
27

 1   arrested for the shooting death of another person, with the
 2   shooting occurring after the death of Mr. Fuimaono. He is now
 3   charged with the death of Mr. Fuimaono.
 4        The Fuimaono family obviously lives in extreme fear of harm
 5   and retaliation. They actually moved from their house, but
 6   shortly thereafter Katherine moved into the house next door, as
 7   the coast was clear by then.
 8        Katherine suffered–as did her children– severe trauma and
 9   distress over this event. That event occasioned her counseling
10   for the grief. To her substantial credit, Katherine did not
11   “relapse” or use drugs until just recently, almost 14 months
12   later.
13        Katherine has been on pretrial release for almost 3 years,
14   and has been drug testing that entire time.                Her recovery from
15   drug addiction has been extremely successful.
16        Employment and her car. Katherine has been promoted a while
17   back to a Manager position of a Walgreens Store, with full time
18   wages and benefits.         Her income has allowed her to purchase a
19   car, on payments, for the first time in quite some time. With
20   her husband passing, she does not want to lose her job as it is
21   a very essential part of her life, and she has worked very hard
22   to get to where she is with that.
23        Katherine’s adult daughter Chantel will be in attendance
24   at   the   hearing     to   provide     all    of   the    relevant    factual
25   background to support Katherine’s presentation at the hearing.
