1 Be it enacted by the Senate and House of Representa-
2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the ‘‘SBA Artificial Intel-
5 ligence Utilization Act of 2026’’.
6 SEC. 2. REPORTS REGARDING ARTIFICIAL INTELLIGENCE
7 AND MACHINE LEARNING USE BY THE SMALL
8 BUSINESS ADMINISTRATION.
9 Section 10(c) of the Small Business Act is amended
10 to read as follows:
11 ‘‘(c) ARTIFICIAL INTELLIGENCE AND MACHINE
12 LEARNING USE REPORTS.—
13 ‘‘(1) REPORTS REQUIRED.—Not later than 90
14 days after the date of the enactment of this sub-
15 section, and annually thereafter, the Administrator
16 shall submit to the Committee on Small Business of
17 the House of Representatives and the Committee on
18 Small Business and Entrepreneurship of the Senate
19 a report on—
20 ‘‘(A) the use of artificial intelligence and
21 machine learning by the Administration;
22 ‘‘(B) the benefits and risks posed by the
23 use of artificial intelligence and machine learn-

24 ing in the work of the Administration, including

1 in impeding the operations of the Administra-
2 tion; and
3 ‘‘(C) measures that the Administrator can
4 take to effectively identify, evaluate, and man-
5 age such benefits and risks, including expla-
6 nations of how the Administrator can—
7 ‘‘(i) retain human involvement in im-
8 portant decisions informed by rec-
9 ommendations made by artificial intel-
10 ligence or machine learning;
11 ‘‘(ii) identify tasks and functions that
12 artificial intelligence or machine learning
13 can and cannot reliably and effectively per-
14 form, including whether artificial intel-
15 ligence and machine learning can improve
16 operations, productivity, or customer serv-
17 ice;
18 ‘‘(iii) determine which specific artifi-
19 cial intelligence or machine learning tools
20 are appropriate for a particular task or
21 function, if such task or function is deter-
22 mined to have the potential to be reliably
23 and effectively performed by artificial intel-

1 ‘‘(iv) determine whether an artificial
2 intelligence or machine learning tool ade-
3 quately fills a need of the Administration
4 and is worth adopting to fulfill such need.
5 ‘‘(2) BRIEFING REQUIRED.—Not later than 30
6 days after the date on which the Administrator sub-
7 mits each report required under paragraph (1), the
8 Administrator shall provide to the committees de-
9 scribed in such paragraph a briefing on such report.
10 ‘‘(3) DEFINITIONS.—In this subsection, the
11 terms ‘artificial intelligence’ and ‘machine learning’
12 have the meanings given, respectively, in section
13 5002 of the William M. (Mac) Thornberry National
14 Defense Authorization Act for Fiscal Year 2021 (15
15 U.S.C. 9401).’’.
