Eric Gadd and Withdrawal of Debra Lee Allen filed in this matter on January 20, 2026 [ECF No. 477]. Please take notice that as a result of the retirement of Debra Lee Allen, the undersigned, W. Eric Gadd, of the law firm of Spilman Thomas & Battle, PLLC, will appear as counsel for the West Virginia Economic Development Authority (“WVEDA”), a creditor and party in interest in the above-captioned bankruptcy case, pursuant to sections 102(1) and 342 of title 11 of the United States Code (the “Bankruptcy Code”) and Rule 9010(b) of the Federal Rules of Bankruptcy Procedure, and pursuant to Fed.R.Bankr.P. 2002, 3017 and 9007 and section 342 of the Bankruptcy Code request that all notices given or required to be given and all papers served in this case be delivered to and served upon the lawyer identified below at the following address: W. PLEASE TAKE FURTHER NOTICE that this Notice of Appearance and Request for Notice is not (a) a waiver or release of the WVEDA’s rights against any person, entity or property; (b) a consent by the WVEDA to the jurisdiction of this Court with respect to this case or other cases, if any, commenced in this case against or otherwise involving the WVEDA; (c) a waiver or release of the WVEDA’s right to trial by jury as to any and all matters so triable herein or in other matters or proceedings, if any, commenced in the case against or otherwise involving the WVEDA or in any case, controversy or proceeding related hereto, whether or not the same be designated legal or private rights and notwithstanding the designation or not of such matters as “core proceedings” pursuant to 28 U.S.C. § 157(b)(2), and whether such jury trial right is pursuant to statute or the Unites States Constitution; (d) a waiver or release of the WVEDA’s right to have any and all final orders in any and all non-core matters or proceedings entered only after de novo review by a United States District Court Judge; (e) a waiver of the right to move to withdraw the reference in any proceeding which may be commenced in this case against or otherwise involving the WVEDA; or (f) an election of remedy.
