1 Be it enacted by the Senate and House of Representa-
2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the ‘‘Transparency and Pre-
5 dictability in Small Business Opportunities Act’’.
6 SEC. 2. SMALL BUSINESS ADMINISTRATION RULES FOR
7 CANCELLED COVERED SOLICITATIONS.
8 (a) IN GENERAL.—Not later than 180 days after the
9 date of the enactment of this Act, the Administrator of
10 the Small Business Administration shall issue rules as fol-
11 lows:
12 (1) Requiring disclosure of information about a
13 covered solicitation that was issued and cancelled
14 that includes the following:
15 (A) A justification for the cancellation of
16 such covered solicitation.
17 (B) Available information about any plans
18 to reissue such covered solicitation and any as-
19 sociated timeframes for such reissuance.
20 (C) Available information about any plans
21 to include the requirements of such covered so-
22 licitation in another contract or task order of
23 the Federal agency.
24 (2) With respect to a cancelled covered solicita-

1 issue, establishing procedures for the referral of a
2 small business concern (as defined under section 3
3 of the Small Business Act (15 U.S.C. 632)) that
4 prepared a bid for such covered solicitation to the
5 Director of Small and Disadvantaged Business Utili-
6 zation (as defined in section 15(k) of such Act (15
7 U.S.C. 644(k))) of the Federal agency for assistance
8 in identifying similar contracting opportunities.
9 (b) PUBLICATION.—The information required under
10 subsection (a) shall be made publicly accessible on the sin-
11 gle, Government-wide point of entry described under sec-
12 tion 1708 of title 41, United States Code.
13 (c) COVERED SOLICITATION DEFINED.—The term
14 ‘‘covered solicitation’’ means a solicitation of a Federal
15 agency for a procurement for which two or more small
16 business concerns were eligible to submit a bid.
17 SEC. 3. DUTIES FOR DIRECTORS OF OFFICES OF SMALL
18 AND DISADVANTAGED BUSINESS UTILIZA-
19 TION RELATING TO CERTAIN CANCELLED SO-
20 LICITATIONS.
21 Section 15(k) of the Small Business Act (15 U.S.C.
22 644(k)) is amended—
23 (1) in paragraph (21), by striking the period at
24 the end and inserting ‘‘; and’’; and

1 (2) by adding at the end the following new
2 paragraph:
3 ‘‘(22) shall, when notified by a small business
4 concern that a Federal agency cancelled a solicita-
5 tion for which such concern prepared a bid and such
6 Federal agency does not intend to reissue such solic-
7 itation, assist such concern with identifying similar
8 contracting opportunities.’’.
9 SEC. 4. COMPLIANCE WITH CUTGO.
10 No additional amounts are authorized to be appro-
11 priated to carry out this Act or the amendments made
12 by this Act.
