AGREED SCHEDULING ORDER
On April 29, 2020, this matter came before the Court on the Motion of Panthera Training,
LLC to join a motion to convert or dismiss filed by the United States Trustee (Docket # 119).
At the hearing, the Court advised the parties that the motion to join cited grounds to dismiss that
were outside the scope of the grounds cited in the United States Trustee’s motion. When
Panthera Training LLC expressed its desire to go forward on those grounds, the Court directed
Panthera Training LLC to file an amended independent motion and directed the interested parties
to confer and agree to deadlines for the adjudication of the motion. West Virginia Economic
Development Authority (“WVEDA”) indicated it may also file a motion to convert based on
cause, or alternatively, may join the motion of Panthera Training, LLC. WVEDA agreed to abide
by the briefing and discovery schedule below. The interested parties have conferred and agreed
to the following deadlines, which the Court hereby ORDERS:
Date by which Panthera Training LLC’s amended motion will be filed: May 8, 2020;
Date by which Debtor will respond to the amended motion: May 22, 2020;
Date by which the U.S. Trustee will respond to the amended motion and Debtor’s
response: May 29, 2020;
Date by which discovery will be completed: June 5, 2020.
