Schulman representing USA Sentencing Hearing (Sentencing Hearing Non-evidentiary) The Court adopted the Presentence Report and made it the findings of the Court, subject to the Court overruling the Government's objection to the loss amount. The matter of restitution was left open by the Court. The Court heard from Government's and Defendant's counsel as to the Government's 5K1.1 motion and the parties' sentencing recommendations. The Court granted the Government's 5K1.1 motion and pronounced the sentence as 1 year and 1 day CBOP, 3 years supervised release, no fine, restitution in an amount to be determined at a later date, and a special assessment of $100. The Court inquired about objections to the sentence. Government's counsel objected to the below-guideline sentence. Defendant's counsel objected to the substantive reasonableness of the sentence and to the Court's imposition of drug testing as a mandatory condition of supervised release. The Court advised Defendant of his right to appeal his sentence. Within 14 days, defense counsel will file a brief addressing restitution. The Government will have 14 days to respond.
