ORDER
This matter comes before the Court on the Government’s motion regarding
the failure of the Defendant to provide medical information necessary to allow the
United States Marshal to transport the Defendant for mental health treatment
pursuant to this Court’s earlier Orders. This matter is time sensitive due to the
shortage of appropriate treatment facilities and the logistics related to
accommodating Defendant’s medical needs.
A hearing was held on May 8, 2024. The third-party custodian appeared and
testified. She acknowledged that no medical records had been produced pursuant to
the Court Orders but stated that she had made efforts to obtain them. Upon further
inquiry, she also testified that, despite the Defendant’s continuing serious medical
issues, he has not received any professional medical care since his return from his
evaluation in South Carolina.
It thus appears that there are no recent medical records available that would
provide the Marshal’s Service adequate information to assure safe transport to

Massachusetts as contemplated by the Court’s Orders and the arrangements made
with the Bureau of Prisons.
As stated in open Court at the hearing, the parties (including the Marshal’s
Service) are DIRECTED to confer as to the matters discussed at the hearing and
file a status report no later than 3:00 P.M. EDT Friday May 10, 2024, regarding
possible next steps including having the Defendant medically examined to
determine his needs with respect to transportation by the Marshal and the
availability and cost of private medical transport.
