Summary

A Preliminary Order of Forfeiture for Proceeds in United States v. Desmond Dondre Williams, No. 3:22-cr-00134-HLA-MCR, in the U.S. District Court for the Middle District of Florida, Jacksonville Division, filed March 21, 2023 as Doc. 29. The Court grants the United States' unopposed motion (Doc. 28) and finds that at least $39,327 was obtained by the defendant as a result of the wire fraud offenses to which he has pled guilty. Under 18 U.S.C. § 981(a)(1)(C), 28 U.S.C. § 2461(c) and Fed. R. Crim. P. 32.2(b)(2), it holds the defendant liable for forfeiture of $39,327. Because the order states the proceeds were dissipated, it allows the United States to seek substitute assets under 21 U.S.C. § 853(p) up to that value, and provides that the order becomes final as to the defendant at sentencing.
