 MOTION TO CONDUCT HEARING BY VIDEO TELECONFERENCING (VTC)


      Paul D. McCown, through his attorney, P. Craig Silva, Assistant Federal

Public Defender, requests that the Court allow Defendant’s Probation Modification

hearing scheduled for October 1, 2026, at 1:00 p.m. to take place by video

teleconference (VTC).

      McCown was placed on supervised release in approximately March 2025.

McCown is currently supervised in California. However, jurisdiction of this matter

was not transferred to California and remains with this court.

      Mr. McCown is living and working in California. He is doing well on probation

and has no violations. Mr. McCown does not have the financial means to be able to

travel back to California after his hearing, even with the assistance of the U.S.

Marshal Service transportation for one-way travel and expenses to the hearing. For

the purpose of personal and judicial cost-saving measures, Mr. McCown requests that

he be able to appear for this hearing via VTC. Defense counsel has consulted with

Mr McCown, and he has consented to this court conducting the scheduled hearing by

VTC.

       Defense Counsel has spoken with Assistant United States Attorney, Christyne

Martens, and AUSA Martens has no objection to this hearing being conducted via

VTC.

       Accordingly, Mr. McCown requests that her initial appearance hearing

scheduled for October 1, 2026, be allowed to take place by video teleconference (VTC).

       At the outset of the hearing, this court should advise Mr. McCown of his right

to appear in person and ensure that he validly consents to proceed by VTC. Although

this consent must be counseled, it need not be in writing.
