Dear Judge Koeltl:  
 
The parties in the above-captioned case write jointly to request the Court’s approval of 
additional provisions for the Joint Deposition Protocol and Coordination Order (“Coordination 
Order”) entered by the Court at the parties’ request on March 9, 2026 (ECF No. 133 in United 
States v. Visa Inc.; ECF No. 202 in In re: Visa Debit Card Antitrust Litig.).  The amendments to 
the Coordination Order, which are confined to a new Section VII, are intended to facilitate the 
prompt scheduling of non-party depositions by expediting resolution of any disputes concerning 
the proper scope of document discovery from those non-parties that may affect the timing of those 
depositions. 
 
The parties additionally request the Court’s approval of certain amendments to the Joint 
Amended Scheduling and Case Management Order, entered by the Court at the parties’ request on 
January 22, 2026 (ECF No. 123 in United States v. Visa Inc.).  Those amendments adjust the 
parties’ obligations respecting the updated preliminary and final fact witness lists. 
 
The requested amendments are reflected in proposed orders submitted with this letter.  The 
amendments will not affect the overall schedule in either case; on the contrary, they are intended 
to aid the parties in meeting the case deadlines currently in effect.
