Summary

A stipulation and order regarding complaint and answer in United States v. Visa Inc., Civil Action No. 1:24-cv-07214 (JGK), U.S. District Court for the Southern District of New York, dated August 21, 2025 and filed August 22, 2025 as Document 108. It recites that the complaint (ECF No. 1) alleges violations of Sections 1 and 2 of the Sherman Act, 15 U.S.C. §§ 1, 2, and that Visa's Answer (ECF No. 98) asserts defenses including the statute of limitations and laches. It states that the United States is not seeking monetary damages and is proceeding solely in its sovereign capacity, and that in reliance on those representations Visa is willing to withdraw its Ninth and Tenth Defenses. The order grants Visa leave to file an Amended Answer withdrawing them. It is signed by counsel for the Department of Justice Antitrust Division and for Visa, and by Judge John G. Koeltl.
