THE CLERK:  We are.  Thank you.  
THE FDC OFFICER:  Okay.  
THE CLERK:  The next matter on the calendar is 
CR20-174-JCC, United States of America v. Eric Shibley.
Counsel, please make your appearances for the record.  
MR. WERNER:  Good morning, Your Honor.  Brian Werner on 
behalf of the United States.  
THE COURT:  Mr. Werner.  
MS. CONNELLY:  And Laura Connelly on behalf of the 
United States.  
MR. NANCE:  And Michael Nance for Eric Shibley. 
THE COURT:  Mr. Nance, I understand you are stipulating 
to competency at this point?  
MR. NANCE:  Yes, that's correct.  
THE COURT:  All right.  Is the government satisfied that 
that's satisfactory?  
MR. WERNER:  Yes, Your Honor.  The government has filed 
the redacted competency report.  I think with that redacted 
report by Dr. Low and Mr. Nance's stipulation, I think there's 
enough evidence for the Court to find that Mr. Shibley is 
competent to proceed to trial here.  We request the Court to sign 
that order. 
THE COURT:  I make such a finding.
And as I understand it, Mr. Nance, you're proposing that we

set it for a status conference in early April, to consider a jury 
trial sometime thereafter?  
MR. NANCE:  Yes, Your Honor.  
THE COURT:  Okay.  Let me ask that the government 
prepare proposed speedy trial findings and submit those to us.  
If you could get them to us tomorrow, I would appreciate it.  
MR. WERNER:  Yes, Your Honor. 
THE COURT:  And give me an early April status date.  
THE CLERK:  Tuesday, April 6th, at 9 a.m., Your Honor. 
THE COURT:  Does that work for you, folks?  
MR. WERNER:  Yes, Your Honor. 
MR. NANCE:  That works for us, Your Honor, or for me. 
THE COURT:  Okay.  Anything else?  
Great.  Thank you, counsel.  We will be in recess.  
MR. WERNER:  Thank you.
