Plaintiffs Alicia Marshall, Paris Townsend, Kristina Henderson, Jamie Jones, John
Martin, Gregory Lloyd, Alyshia Johnson, Lametria Marvel, Jahbrael Horne and Sharon Bradley
Smith (collectively, “Plaintiffs”) and defendant Prestamos CDFI, LLC (“Prestamos”)
respectfully submit this joint status report in response to the Court’s Order dated July 21, 2025.
(ECF No. 168.)
As previously reported to the Court by email on July 16, 2025, the parties reached an
agreement in principle to settle this litigation in full subject to executing their written settlement
agreement. As also then previously reported to the Court, the parties’ agreement in principle to
settle this litigation is on an individual (i.e., non-class action) basis and therefore would not
require the approval of the Court, which has denied class certification. (ECF Nos. 152 – 153.)
On July 30, 2025, the parties finalized a written settlement agreement. On July 31, 2025,
Plaintiffs signed the settlement agreement; Prestamos expects that its signatory will become
available and authorized to sign by August 8, 2025. The parties’ settlement agreement
contemplates that subject to compliance with the terms of the parties’ settlement, Plaintiffs with
Prestamos’s consent will file a notice voluntarily dismissing this lawsuit in full pursuant to Rule
41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, within nineteen (19) days after execution
by all parties. Accordingly, the parties respectfully request that the Court continue to stay all
proceedings in this case until August 27, 2025, the day the parties expect that Plaintiffs with
Prestamos’s consent will file their notice voluntarily dismissing this litigation in full and with
prejudice.
