For the reasons stated in Defendant’s unopposed motion for an extension of time, the 
Court GRANTS an extension from February 14, 2023 to March 16, 2023, for newly retained 
counsel to review the discovery, file any necessary additional pretrial motions, and if no 
additional motions are filed, for counsel to file the required joint status report.1  (Doc. no. 88.)  
Pursuant to 18 U.S.C. § 3161(h)(7), this period is excluded in computing the time within which 
trial must commence because the extension (1) is not for the purpose of delay, but instead to 
further justice and protect Defendant’s right to a fair trial by allowing reasonable time 
necessary, assuming due diligence, for effective preparation of counsel; and (2) serves the ends 
of justice and outweighs all interests in a speedy trial.  Defense counsel shall not file 
“preliminary” motions.  All motions must comply with LR Crim. 12.1, including the provisions 
concerning affidavits, citations to record evidence, and supporting memoranda.

1If additional defense pretrial motions are filed, the Court will re-set the deadline for filing
