CRIMINAL ACTION FILE NO. 1:20-CR-228-MHC-JKL-2 ORDER This case is before the Court on Defendant Daniel Jay’s oral motion to continue the pretrial conference scheduled for May 19, 2021. On May 17, 2021, chambers staff received an emailed from Mr. Jay requesting another extension: I am not the name. I do not claim the name. I do not claim liability for the name. As of the date of this email, Discovery from the UNITED STATES Attorney’s office regarding DANIEL ERIC JAY has not been received by the agent of record. After several attempts to deliver a 2 Terra Byte hard drive to the office of J. Russell Phillips, starting on March 30.2021, a delivery of the hard drive was finally made on Friday May 7, Case 1:20-cr-00228-MHC-JKL Document 190 Filed 05/17/21 Page 1 of 7 2021. (see attachment) Attorney J. Russell Phillips was informed via email of the delivery, on Friday May 7, 2021. (See attached) Will not be able in a timely manner any kind of repudiation to the charges. Requesting more time to prepare. By:JAY, :daniel: Agent of Record for the Pennsylvania Registered Organization doing business as DANIEL ERIC JAY.1 Upon consideration, Mr. Jay’s request to continue the pretrial deadlines is GRANTED. Mr. Jay shall have until June 18, 2021 to file any necessary pretrial motions. The pretrial conference is hereby rescheduled to Monday, June 21, 2021, at 9:30 a.m.2 The Court is not inclined to grant further extensions, absent very good cause shown. The Clerk is DIRECTED to exclude time between the original and the rescheduled pretrial conference hearing, under the Speedy Trial Act because the 1 Mr. Jay attached three images to his email that appear to show tracking information for a package he sent to Assistant U. S. Attorney Russell Phillips. The Court attaches those images as Attachment A. 2 In light of the Public Health State of Emergency that currently exists in the State of Georgia due to the spread of the Coronavirus/COVID-19, the pretrial conference will be conducted via Zoom.
