Summary
Clerk's minutes of a status conference held July 6, 2022 in United States of America v. Don V. Cisternino, Case No. 6:21-cr-00016-AGM-DCI, in the U.S. District Court for the Middle District of Florida, Orlando Division, before Judge Wendy W. Berger; the minutes are Document 26. The minutes record that the defense told the Court the case will likely settle but needs more time for discovery, and made an ore tenus motion to continue the trial for 60 days, to which the government did not object. The Court set the case for the October 2022 trial term and a status conference for September 13, 2022. Citing 18 U.S.C. § 3161(h)(7)(B), the Court found that the ends of justice served by the continuance outweigh the interest in a speedy trial and ruled the time until October 31, 2022 excludable under 18 U.S.C. § 3161(h).

UNITED STATES DISTRICT COURT MIDDLE DISTRICT OF FLORIDA ORLANDO DIVISION UNITED STATES OF AMERICA VS. CASE NO: 6:21-cr-16-WWB-DCI DON V. CISTERNINO JUDGE: Wendy W. Berger COUNSEL FOR GOVERNMENT: Courtney Richardson- Jones DEPUTY CLERK: Regina Fermer COURT REPORTER: Heather Suarez heathersuarez.usocr@gmail.com COUNSEL FOR DEFENDANT: Michael Shay Ryan SCHEDULED DATE/TIME: July 6, 2022 09:30 AM INTERPRETER: N/A MINUTES – Status Conference Case called; appearances taken. Defense informed the Court this case will likely settle but they need more time to go through discovery. Makes ore tenus motion to continue the trial for 60 days. The Government does not object to the continuance. The Court sets the case for the October 2022 trial term and a Status Conference for September 13, 2022, at 9:30am (to be set by separate notice). After considering all the factors, including those set forth in 18 U.S.C. § 3161(h)(7)(B), and for the reasons stated on the record, the Court finds that the ends of justice served by granting such a continuance outweigh the best interest of the public and the defendant(s) in a speedy trial. The Court, therefore, determines that the time from today until and including October 31, 2022, shall be "excludable time" pursuant to 18 U.S.C. § 3161(h). Court adjourned. Time in court: 9:34am – 9:37am = 3 minutes. Case 6:21-cr-00016-AGM-DCI Document 26 Filed 07/06/22 Page 1 of 1 PageID 51
