1 MOTION TO FILE DOCUMENTS UNDER SEAL
2 Pursuant to Local Rule 79.2 and Section 12.5 of the Stipulated Protective Order
3 (ECF 82) in this case and the Court’s Civil Pretrial & Trial Procedures, Plaintiffs move to
4 file under seal (1) portions of Plaintiffs’ Memorandum of Points and Authorities in Support
5 of Plaintiffs’ Motion for Class Certification to the Protective Order; (2) portions of the
6 Declaration of Connie K. Chan in support of Plaintiffs’ Memorandum of Points and
7 Authorities, including portions of the Index of Exhibits and Exhibits 1-4, 14-20, 24-51, 54-
8 60, 62, 64-69, 74-102, 104-111, 113-130, 132-148, 150-151, and 153-156.
9 Plaintiffs have tailored their request to seal only such information that the Bank has
10 designated as confidential (highlighted in yellow) or highly confidential (highlighted in
11 green) pursuant to the Protective Order. However, Plaintiffs dispute the Bank’s
12 confidentiality designations and do not believe there are “compelling reasons” to file
13 these documents under seal and to overcome the “strong presumption in favor of access”
14 to court documents. See Kamakana v. City & Cnty. of Honolulu, 447 F.3d 1172, 1178,
15 1180, 1185-87 (9th Cir. 2006); Nia v. Bank of America, 21-cv-1799, 2024 WL 171659, at
16 *3 (S.D. Cal. Jan. 12, 2024) (denying Bank of America’s motion to seal a group of
17 investigation policy documents and rejecting the Bank’s assertions that the policy
18 documents were “highly sensitive trade secrets” that would “allow illicit actors to
19 circumvent” Bank security measures); Civil Pretrial & Trial Procedures at 4-5. Plaintiffs
20 have initiated the meet and confer process for challenging the Bank’s designations under
21 the Protective Order, but because that process has not yet been completed, Plaintiffs are
22 filing this sealing motion in accordance with the Protective Order and the Local Rules.
