MINUTE TEXT:       Foster’s witnesses Jennifer Murray and Jane Holmes testified. Foster’s witness, Ricky
                   Dixon, was advised of his rights under the Fifth Amendment and testified. Defense
                   objected to Mr. Dixon invoking his Fifth Amendment privilege. The Court advised
                   Foster of his rights and confirmed his decision not to testify. Foster rested. Defendant
                   Jackson’s witness, John Gaines, was advised of his rights under the Fifth Amendment
                   and testified. The Court advised Jackson of her rights and confirmed her decision not to
                   testify. Defendant Jackson rested. The government withdrew its motion to allow in co-
                   defendants’ plea agreements and called Agent Stites for their rebuttal case. The Court
                   dismissed the jurors until the morning and heard argument from parties on the
                   Defendants’ renewed rule 29 motions for judgment of acquittal as to all counts. The
                   Court DENIED the oral motions and conducted a charge conference to amend the
                   proposed jury instructions. The briefs on Defendant Foster’s supplemental charge
                   request are due by 8:30 AM on 2/14. The Court reviewed the verdict form.
HEARING STATUS:    Hearing not concluded. Court adjourned and will reconvene at 9:00 AM on February 14,
                   2024. Jurors excused until the above time under the usual caution of the Court.
TRIAL STATUS:      Evidence Entered, Continued
EXHIBIT STATUS:    Exhibits retained by the Court to be forwarded to the Clerk's Office.
