MINUTE TEXT:        Defense paused their cross examination of Agent Stites to allow testimony from
                    witnesses out of order by consent of the parties. Government’s witnesses Samantha
                    Beechan, Shelli Hayman, Marc Rehberger, Meghan Musil, Aaron Bloom, and James
                    Berni testified. James Berni was tendered and admitted as a cell site expert witness.
                    Defendant Foster moved to deny Berni’s expert testimony and for a mistrial on the
                    grounds that Mr. Berni relied upon a document newly provided to the government; the
                    Court denied the motions. Defendant’s witness Jim Persinger testified and admitted as a
                    digital forensic cybercrime and cellular data expert.
HEARING STATUS:     Hearing not concluded. Court adjourned and will reconvene at 9:30 AM on February
                    12, 2024. Jurors excused until 10:00 AM under the usual caution of the Court.
TRIAL STATUS:       Evidence Entered, Continued
EXHIBIT STATUS:     Exhibits retained by the Court to be forwarded to the Clerk's Office.
