MINUTE TEXT: The government stated it plans to call around 20 witnesses and estimated 10 days plus
the additional time needed for Defendants' extensive cross examinations; Defendants
Foster, Jackson and Gaines each estimated less than a day for their presentations. The
Court discussed parties' proposed voir dire and ruled on parties’ objections. The Court
granted the parties’ request for up to 30 minutes each for opening statements and took
under advisement the government’s request for 90 minutes closing and Defendants’
requests for 45 minutes each for closings. The Court advised counsel to work out
amongst themselves the order of defendants’ presentations during trial. Defendants’

unopposed requests for an additional four preemptory strikes each were taken under
advisement. Defendant Foster’s reply brief to [830] Motion for Relief to Exclude
Expert Testimony is due by noon on January 25. The Court heard argument from
counsel on the pending motions in limine. The Court DENIED without prejudice to
renew at trial [788] Motions in Limine. The Court granted the government’s [796]
Motions in Limine as to the self-authentication evidence subject to determination
about relevance as unopposed, except as to the documents provided by
Transportation Management, with Defendants reserving the right to object on
relevance grounds as needed. The Court granted Foster’s [790]/[803] Motions to
Compel in part. The government is charged with redacting and distributing the
partially redacted sentencing memo and PSR for Gena Pyfrom-Foster as noted in
open court, as well as providing the IRS testimony script to defense. The request for
PSRs of other non-testifying witnesses was denied. Foster’s [791] Motion to Play
Implicit Bias Video was denied. The government’s [829] Motion to Compel Expert
Discovery and Exclude Certain Opinion Testimony was denied as moot as to the
custom scripts request and granted as to the hearsay concern.
