Counsel,

Following our meet and confer regarding custodians yesterday, we are writing to get back to you with the Bank’s
position regarding additional ESI collection. The Bank believes that given the extensive and extremely
burdensome and costly discovery that has already been provided in this case, any additional ESI collection and
production would be unduly burdensome, not proportional to the needs of the case, and unlikely to yield
significant, relevant, non-duplicative discovery. However, in the interest of compromise, please find below BANA’s
revised counterproposal for additional ESI collection. This proposal is contingent on Plaintiffs agreeing not to seek
the 17 other custodians identified on November 29, and on the parties reaching an agreement as to the search
parameters for this additional ESI collection.
